Unanswered: buying a new phone from ebay.

does anyone know where a person stands if they buy a new unwanted upgrade sold by someone on ebay if say for eg.
after 2 months (or however long) the phone should develop a fault.
is the only course of action to get it repaired from the manufacturer under the one year warranty and if the phone is sim-locked to a network does the network still bear any responsibility?
